ABSTRACTFrom a specific point of view, mediation is the process whereby a third party helps to change their attitude from an adversarial one to a collaborative one which allows them to work together in finding and creating solutions to their conflict. Mediation deals with conflict from its own perspective and it has its own status as a dispute resolution process in the systems of justice, where it is recognized. The Philosophy of Mediation has been developing as a discipline, which analyses (...) the status of mediation as knowledge. It studies its nature, its constituent elements, its ontological foundations and its connection with other disciplines. This article argues that it is possible to include certain basic principles of the philosophy of María Zambrano in the Philosophy of Mediation framework. Those elements are essential for understanding the world of human conflict since they provide a new perspective from which to see dispute resolution methodologies. They can be summed up in the idea of including the hidden as the substrate of the visible, revealing the underlying forces of human existence. Within the context of the mediation, the understanding of these forces could help to resolve conflicts. (shrink)

On a Dreyfusian account performers choke when they reflect upon and interfere with established routines of purely embodied expertise. This basic explanation of choking remains popular even today and apparently enjoys empirical support. Its driving insight can be understood through the lens of diverse philosophical visions of the embodied basis of expertise. These range from accounts of embodied cognition that are ultra conservative with respect to representational theories of cognition to those that are more radically embodied. This paper provides an (...) account of the acquisition of embodied expertise, and explanation of the choking effect, from the most radically enactive, embodied perspective, spelling out some of its practical implications and addressing some possible philosophical challenges. Specifically, we propose: an explanation of how skills can be acquired on the basis of ecological dynamics; and a non-linear pedagogy that takes into account how contentful representations might scaffold skill acquisition from a radically enactive perspective. The percentage of female entrepreneurs is far below the level of males, although it has increased over the past several years. Based on the theory of planned behavior, the purpose of this article is to specify a model in which the relationship among entrepreneurial potential, gender and entrepreneurial intention are explored, by analyzing how perceived behavioral control (PBC) and perceived entrepreneurial skills, as exogenous variables, affect expression of intention for business, and how these are mediated by their entrepreneurial motivations and (...) risk taking propensity. Control variables where also included in this model, such as necessity-driven motives for business, in order to observe whether these are an influential factor. An implementation of Structural Equation Modeling (SEM) was used to analyze data collected from 677 students. Variables within the model were compared by gender using t-Test, and all multivariate analysis were done by each one separately as well in order to better gauge their perceptions. Results showed that mean differences between males and females are not abundant, and come only from intentions, PBC and subjective norm, which are higher in males; and motives for business higher in females. Multivariate analysis shows gender differences at the mediation level and that necessity-driven motives are an influencing factor, more so in males, and it hampers the significance of subjective norm. Finally, the theoretical and practical implications of the results within the framework of entrepreneurship in Spain and future alternatives to improve the entrepreneurial potential are discussed. This article presents a study that identifies the gender dynamics prevailing in a specific context of tokenism – elementary school teaching – in which the members of an otherwise socially dominant group are proportionally scarce – men. The results contradict Kanter’s theory by showing that male elementary school teachers do not experience the tokenism dynamics. In line with Williams’ gender perspective and Amâncio’s gender symbolic asymmetry, the article finds that although men constitute a small minority in elementary education, they do (...) not lose the social advantages they generally have: on the contrary, they seem rather to gain several privileges. Indeed, the results show strong links between the tokenism dynamics and gender asymmetry, putting the token men at an advantage. Thus, tokenism seems to be limited to maintaining the gender social order. (shrink)

Background: Nurse managers have responsibilities relating to the quality of care, the welfare of the staff and running of the organization. Ethics plays significant role in these responsibilities. Ethical problems are part of daily management, but research in this area is limited. Objective: The aim of this study was to identify and describe ethical problems nurse managers encounter in their work to get more detailed and extensive view of these problems. Methods: The data consisted of nine interviews with nurse managers (...) at different management levels in primary healthcare and specialized healthcare organizations, and it was analysed by inductive content analysis. Ethical considerations: Permission to conduct the interviews including ethical approval was given at all participating organizations according to national standards. The respondents were informed about the aim of the study, and voluntary participation, anonymous response and confidentiality were explained to them. Findings: Four main categories were found: conflicts in practical situations, lack of appreciation, disregard of problems and experienced inadequacy. Problems could also be divided to patient-related, staff-related, organization-related and other problems. Discussion: The findings correspond with results from earlier studies but add knowledge of the nature and details of nurse managers’ ethical problems. New information is produced related to the ethical problems with nurse managers’ own courage, motivation and values. Conclusion: Nurse managers identified a variety of different ethical problems in their work. This information is useful in the development of ethics in nursing management. Further research about the frequency and intensity of nurse managers’ ethical problems is needed as well as possible differences in different levels of management. (shrink)

The Coalition of Immokalee Workers (CIW) has successfully combated modern-day slavery by transforming the ways that over a dozen major brands, including Taco Bell, Subway, and Wal-Mart, manage their supply chains. The CIW’s efforts over more than 20 years have effectively stopped enslavement practices, including abuses such as wage theft and peonage indebtedness. We conducted a field ethnography, interviews, and archival analyses to understand this success. We find that the CIW employs a decentered, egalitarian, and ensemble approach to their multiplicities (...) of alliances by collectively “animating” themselves and their partners through ensemble leadership. This combination of alliances, along with worker-driven monitoring, brings life to the CIW motto “We are all leaders.” Translating this motto into daily practice is how the CIW virtually eradicates enslavement practices in corporate supply chains. RESUMO O objetivo deste artigo é analisar e avaliar um conjunto de textos aqui denominados textos-moldura presentes nas obras de Bakhtin e do Círculo traduzidas no Brasil desde 1979, com vistas a traçar um panorama nacional crítico do contexto de recepção da obra bakhtiniana e evidenciar algumas de suas especificidades, indiciadas nos diálogos que empreendem com os aspectos sociais, históricos e culturais. Pretende-se, ainda, contribuir para o aprofundamento dos estudos dialógicos e sua incontestável dimensão interdisciplinar. Além da perspectiva dialógica, as (...) reflexões apoiam-se, também, em teorias da tradução, caso específico da que discute a “relação entre um texto de partida e um contexto de chegada”, ou ainda “um modo de ler um texto em dado contexto”. Parte de uma pesquisa maior, os resultados aqui apresentados dizem respeito unicamente a uma das obras do Círculo: Marxismo e filosofia da linguagem. Problemas fundamentais do método sociológico na Ciência da linguagem e suas duas traduções brasileiras. ABSTRACT This article aims to analyze and evaluate a number of texts called frame-texts found in the works of Bakhtin and the Circle, which have been translated in Brazil since 1979. Our objective is to offer a critical overview of the context of the reception of their work nationwide and highlight some of its specific features, apprehended in the dialogues established with social, historical and cultural aspects. We also intend to contribute to deepening the dialogical studies and its undeniable interdisciplinary dimension. In addition to the dialogic perspective, these reflections rely on theories of translation, especially those that discuss the “relationship between a text and its context of reception” or “a certain way of reading a text in a given context.” This discussion is part of a larger research study, and the results presented herein are related to one of the works of the Circle, namely, Marxism and the Philosophy of Language and its two translations into Brazilian Portuguese. O artigo pretende contribuir com as discussões sobre o ensino de filosofia, partilhando achados de uma pesquisa realizada com duas turmas de estudantes universitários na disciplina de Estética (Curso de Música -Licenciatura). As inovações metodológicas aplicadas nas turmas buscaram valorizar o ensino de filosofia em diálogo permanente com as vivências cotidianas e artísticas dos estudantes através de atividades em sala sistematicamente vinculadas aos temas previstos no programa da disciplina. Os resultados dos dados apontaram que as estratégias metodológicas de ensino utilizadas (...) na disciplina tiveram impacto positivo para o engajamento dos discentes, atuando desenvolvimento de sua criticidade e criatividade. Background: Older people in institutional care should be allowed to live a meaningful life in a home-like environment consistent with their own free will. Research on actualisation of older people’s own free will in nursing home context is scarce. Objectives: The purpose of this study was to describe older people’s experiences of free will, its actualisation, promoters and barriers in nursing homes to improve the ethical quality of care. Research design: Fifteen cognitively intact older people over 65 years in four (...) nursing homes in Southern Finland were interviewed. Giorgi’s phenomenological method expanded by Perttula was used to analyse the data. Ethical considerations: Chief administrators of each nursing home gave permission to conduct the study. Informants’ written informed consent was gained. Findings: Older people described free will as action consistent with their own mind, opportunity to determine own personal matters and holding on to their rights. Own free will was actualised in having control of bedtime, dressing, privacy and social life with relatives. Own free will was not actualised in receiving help when needed, having an impact on meals, hygiene, free movement, meaningful action and social life. Promoters included older people’s attitudes, behaviour, health, physical functioning as well as nurses’ ethical conduct. Barriers were nurses’ unethical attitudes, institution rules, distracting behaviour of other residents, older people’s attitudes, physical frailty and dependency. Discussion: Promoting factors of the actualisation of own free will need to be encouraged. Barriers can be influenced by educating nursing staff in client-orientated approach and influencing attitudes of both nurses and older people. Conclusion: Results may benefit ethical education and promote the ethical quality of older people’s care practice and management. (shrink)

La tradición filosófica ha caracterizado el fenómeno de la normatividad, esto es, la capacidad de actuar según normas, como una capacidad exclusiva del ser humano. En contraposición, dicha tradición ha considerado que el comportamiento de los animales no humanos se reduce a meras respuestas al entorno, relegando su actividad al ámbito del instinto y la supervivencia. Sin embargo, los avances realizados a partir del siglo XX en el campo de la etología permiten cuestionar esta caracterización. El objetivo de este trabajo (...) es mostrar la existencia de aspectos normativos presentes en un tipo de comportamiento observado en diversas especies: el juego social. Realizaremos un análisis conceptual y una revisión crítica de la literatura filosófica y de los resultados reportados por la evidencia empírica relativa al juego social. A partir de una reconstrucción del concepto de “práctica” desarrollado por Rawls (1955), intentaremos mostrar que el juego social presenta características normativas que nos habilitan a extender la noción de práctica más allá de nuestra propia especie. Nuestro principal argumento presenta la siguiente estructura: (1) toda práctica supone, necesariamente, normatividad; (2) el juego social en animales presenta ciertas características estructurales por las cuales resulta pertinente describirlo como un tipo de práctica; y, por lo tanto, (3) la tesis de que ciertas especies de animales no humanos exhiben un comportamiento normativo es, al menos, plausible y merece ser considerada seriamente. We describe the informed consent procedures in a research clinic in Santiago, Chile, and a qualitative study that evaluated these procedures. The recruitment process involves information, counseling and screening of volunteers, and three or four visits to the clinic. The study explored the decision‐making process of women participating in contraceptive trials through 36 interviews. Women understood the research as experimentation or progress. The decision to participate was facilitated by the information provided; time to consider it and to discuss it with (...) partners or relatives; and perceived benefits such as quality of care, non‐cost provision of methods and medical care. For some women, participation was an opportunity to express altruism. The main obstacles for participation were perceived side effects or risks. The final risk‐benefit balance was strongly influenced by women’s needs. Women perceived that the consent form benefited the clinic, proving that participants had made a free decision, and benefited the volunteers by warranting their right to free medical care. The most important problem detected was occasional misunderstanding of the information given on the form. We concluded that a full decision‐making process enhances women’s ability to exercise their right to choose, and assures research institutions that trials are conducted without coercion and that the participants are committed to the study. After a brief introduction to Kuipers' views on explanations of laws we argue that micro-explanations of laws can have two formats: they work either by aggregation and transformation (as Kuipers suggests) or by means of function ascriptions (Kuipers neglects this possibility). We compare both types from an epistemic point of view (which information is needed to construct the explanation?) and from a means-end perspective (do both types serve the same purposes? are they equally good?).

En el conjunto de la historia de la traducción en España, la aportación monacal y de las órdenes religiosas ha tenido una singular importancia. Pero esa actividad, así como la de otros traductores, se revela especialmente interesante en el caso de la Biblia. Un caso concreto, que ofrece quizás el ejemplo más ilustrativo, tanto para descubrir las grandes aportaciones a nuestra cultura de importantes traductores, como la intervención —positiva y negativa— de la Iglesia y de la sociedad en la labor (...) traductora. El recorrido realizado permite sacar algunas conclusiones, que podemos organizar en dos clases: aquellas que se refieren a los hechos históricos estudiados y aquellas que se centran más en la naturaleza de la traducción, y concretamente de la traducción de un texto tan específico y singular como es la Biblia en el mundo occidental. Este ensayo considera, dentro de un contexto narrativo, el asunto de cómo llegar a saber de nuestro amor a partir de una comparación entre el comportamiento escéptico y desconfiado del lector de filosofía y el abierto y confiado del lector de relatos. El artículo explica cómo la filosofía permite clarificar la idea del conocimiento del amor por medio del análisis de los conceptos, descubriendo específicamente que es el amor en el alma y como es su conocimiento; y cómo el relato, (...) señala que el carácter las multiples formas de los aspectos en desarrollo y la evolución temporal de lo narrado, no están presentes en las teorías explícitas y reflexivas. Martha Nussbaum afirma que el corazón humano necesita de la reflexión activa, y que para poderle abrir un espacio a las historias de amor, la filosofía debe ser más literaria, debe tener una relación más estrecha con las narraciones y considerar respetuosamente el misterio y los finales abiertos de las mismas. El presente artículo dialoga con la perspectiva del profesor de la Universidad de Stanford, John Searle en su perspectiva acerca de la conciencia, los actos de habla en lo que tiene que ver con la creación de hechos institucionales y su tesis emergentista. Esto con la idea de proponer la lectura del filósofo estadounidense en base a una pragmática de la expresión, que identifica al agente como centro de la creación y transformación social, y por tanto de movilización política, al (...) ser el reconocimiento colectivo quien mantiene el orden institucional. Por lo tanto, esa pragmática de la expresión identifica a los agentes como puntos esenciales de la creación del mundo social, desde el punto de vista del libre albedrio y la creación de mundos sociales posibles. John Locke's philosophy was deeply affected by medicine of his times. It was specially influenced by the medical thought and practice of Thomas Sydenham. Locke was a personal friend of Sydenham, expressed an avid interest in his work and shared his views and methods. The influence of Sydenham's medicine can be seen in the following areas of Locke's philosophy: his “plain historical method”; the emphasis on observation and sensory experience instead of seeking the essence of things; the rejection of hypotheses (...) and principles; the refusal of research into final causes and inner mechanisms; the ideal of irrefutable evidence and skepticism on the possibilities of certainty in science. The science which for Locke held the highest paradigmatic value in his theory of knowledge was precisely medicine. To a great extent, Locke's Essay on Human Understanding can be understood as an attempt to justify, substantiate, and promote Sydenham's medical method. This method, generalized, was then proposed as an instrument for the elaboration of all natural sciences. (shrink)

One of the most tantalizing questions about the interpretation of Quantum Theory is the objective vs. subjective meaning of quantum states. Here, by focusing on a typical EPR experiment upon which a selection procedure is performed on one side, we will confront the fully epistemic view of quantum states with its results. Our statement is that such a view cannot be considered complete, although the opposite attitude would also pose well-known problems of interpretation.

Studies investigating the COVID-19 pandemic from a psychological point of view have mostly focused on psychological distress. This study adopts the framework of existential positive psychology, a second wave of positive psychology that emphasizes the importance of effective coping with the negative aspects of living in order to achieve greater wellbeing. Trait emotional intelligence (trait EI) can be crucial in this context as it refers to emotion-related personality dispositions concerning the understanding and regulation of one’s emotions and those of others. The present study investigated the relationship between trait EI and both wellbeing and psychological distress (i.e., depression, anxiety, and stress), while exploring the mediating role of meaning-centered coping (proactive transformative strategies based on meaning in life) and maladaptive coping (i.e., behavioral disengagement and self-blame) during the first few months of the COVID-19 pandemic. A sample of 326 Lebanese adults completed measures of trait EI, wellbeing, psychological distress, coping, and meaning-centered coping. Results showed a strong positive correlation between trait EI and meaning-centered coping. Trait EI also correlated positively with wellbeing and negatively with psychological distress. Structural equation modeling showed that meaning-centered coping partially mediated the relationship between trait EI and wellbeing. Maladaptive coping fully mediated the relationship between trait EI and psychological distress. Findings indicate that trait EI is positively related to dealing with a stressful situation such as the pandemic in positive ways at both the cognitive level, by reformulating the situation to see something valuable in it, and behavioral level, by being proactive about it. Trait EI was positively linked to seeing the situation as an opportunity for personal growth, finding personal meaning in this situation, maintaining an attitude of hope and courage, and acting more responsibly with one’s self and others during the current crisis. In turn, this coping formula was related to lower psychological distress and improved mental health. These results are consistent with the existential positive psychology framework and can inform implementation programs and policies aiming at raising awareness and promoting healthy and successful coping during the pandemic. The ramifications of including genetic components in the clinical studies conducted in non-academic settings create unique ethical challenges. We used a qualitative research design consisting of semi-structured interviews that took place between October 2010 and September 2012. The sample consisted of 80 participants − 38 physicians and 42 coordinators − who worked across a number of different settings, including clinics, private practices, small hospitals, free standing research centers, and blended hospital-institutes in both rural and urban communities in 13 states across (...) the United States. The respondents primarily conducted industry sponsored trials and recruited their own patients as research participants. A majority of the respondents (65%) reported that most of the studies they conducted included an additional genetics component, and so participants were asked to donate specimens for genomics or biobanking. While genomics association studies were perceived as being of benefit, awareness of ethical implications associated with such studies was limited. The rapid advances in genetic technologies make it hard for clinicians and coordinators to help patients make informed decisions about participating in clinical research, and underscore the need to ensure that the regulations governing research on human subjects keep pace with the social and technological changes. It seems essential to discern legitimate ethical concerns and find ways to convey what is going on, what is possible and what might not be possible in terms of protecting privacy, anonymity, and confidentiality. O presente artigo pretende deslindar o cenário teórico da primeira investigação de Logische Untersuchungen, refazendo o percurso de Husserl na fundamentação da teoria da significação. Obstina-se, ainda, apontar os elementos fulcrais que possibilitarão a fundamentação da fenomenologia, bem como os embates de Husserl com alguns eminentes pensadores da tradição lógica.

This chapter draws parallels between Leopoldo Zea and Stanley Cavell's thought. It forms the basis of this argument in their thought on circumstantialism. Cavell and Zea both reflect on the American circumstance, a circumstance conditioned by the discovery, colonizations, and nationalization of Americas, together with the American people's heroic desire to connect, continuously and urgently, with themselves and their destiny as Americans.

We propose a mathematical model for a class of predator–prey systems more complex than the usual one, involving a commensalism effect consisting in an influence of the predator on the sustainability of the prey. This effect induces interesting new features, including bi-stability. The question of the possibility of reaching a certain attractor starting from initial conditions with a small population of predators, which presents an interest from the vewpoint of the onset of the predator in evolution, is addressed. We propose (...) two possibilities: the classical one involving adapted conditions in the far past and a new one using biodiversity, specifically the presence of another predator which operates as a starter, being displaced in the sequel.
